WRIT PETITION

A Writ Petition is a constitutional remedy through which an individual or organization can approach the High Court under Article 226 of the Constitution of India to challenge an illegal, arbitrary or unjust action, order, or inaction of a public authority and seek appropriate directions from the Court.

WRITS

Under the Constitution of India, courts can issue five principal writs to protect rights and ensure lawful exercise of public power:

  • Habeas Corpus – protects against unlawful detention by directing that a detained person be brought before the Court.

  • Mandamus – directs a public authority to perform a legal duty that it has failed or refused to perform.

  • Certiorari – enables a higher court to quash an order or decision of a lower court, tribunal, or authority when it has acted unlawfully.

  • Prohibition – prevents a lower court or tribunal from proceeding with a matter beyond its jurisdiction.

  • Quo Warranto – challenges the unlawful occupation of a public office and asks the authority-holder to show the legal basis for holding that office.

Article 32 empowers the Supreme Court to issue writs primarily for enforcement of Fundamental Rights, while Article 226 gives High Courts wider writ jurisdiction for enforcement of Fundamental Rights and for other legal rights.
